Terms of Service

1. Agreement to Terms

By registering, accessing, or utilizing the AuraPix AI platform, websites, and associated mobile services operated by SB Photo Art Technologies ("AuraPix AI", "we", "our"), you ("Studio Owner", "User", "Subscriber") agree to be bound by these Terms of Service. If you disagree with any provision, you may not use the services.

2. 3-Day Free Evaluation Period

We provide a risk-free 3-day evaluation period for all photography studios:

• No credit card, debit card, or payment details are required to initiate the trial.
• Access to all 50+ core features across AI face discovery, client galleries, gear management, and quotation generation is fully unlocked.
• Upon expiry of 3 days, you may elect to upgrade to Starter, Professional, or Enterprise tiers. If no plan is selected, accounts gracefully pause without data loss for 30 calendar days.

3. Intellectual Property & Studio Copyright Ownership

Your creative work is the heartbeat of your studio business:

• Your Content: You retain sole copyright, moral rights, and commercial ownership over all digital media uploaded to your workspace.
• Limited Hosting License: You grant AuraPix AI only the technical license strictly necessary to store, generate multi-resolution previews, calculate facial landmark embeddings, and transmit files to your authorized wedding couples and guests.
• No AI Model Training: We will never use your private wedding photographs to train public generative image models or sell your photos to stock photography libraries.

4. Subscriptions, Payments & Non-Refundable Digital Product Terms

Commercial subscriptions are billed on a Monthly or Yearly pre-paid basis:

• Digital Product Non-Refundable Policy: AuraPix AI is an intangible digital SaaS product. Once a subscription plan is purchased, cloud storage and compute GPU resources are provisioned immediately. Therefore, all digital subscription sales and renewals are strictly final and non-refundable. Studios are encouraged to fully test all features during the 3-Day Free Trial prior to upgrading.
• Indian GST Compliance: All subscription fees are subject to 18% Goods & Services Tax (GST) as mandated by the Government of India. Studios with a registered GSTIN receive compliant tax invoices for input tax credit (ITC) claims.
• Yearly Discount: Yearly billing plans benefit from a 30% discount compared to standard monthly billing.
• Automatic Renewal: Subscriptions renew automatically unless cancelled prior to the billing renewal date from your Studio Dashboard or via WhatsApp support (+91 89552 34292).

5. Acceptable Use Policy (AUP)

As a professional studio platform, you agree NOT to upload or distribute:

• Content that violates third-party copyright, privacy, or trademark rights.
• Obscene, defamatory, unlawful, hateful, or abusive media under the Information Technology Act 2000.
• Malicious software, worms, viruses, or automated scraping scripts designed to compromise platform stability.

6. Storage Allocations & Fair Bandwidth Usage

Storage is allocated according to your subscribed tier (Starter: 100 GB, Professional: 500 GB, Enterprise: 1,000+ GB):

• High-speed Content Delivery Network (CDN) bandwidth is included for standard wedding client viewing, shortlisting, and guest downloads.
• Additional storage top-up bundles (e.g. +250 GB, +1 TB) can be added to any active plan without changing your anniversary billing cycle.

7. WhatsApp Cloud API & Messaging Policy

Automated quotation links, event galleries, and anniversary greetings delivered via WhatsApp utilize Meta's official WhatsApp Business Cloud API. Studios must ensure they have client consent to send wedding communication and must not use AuraPix AI for unsolicited promotional spam.

8. Service Level Agreement (SLA) & 99.9% Uptime Commitment

We recognize that wedding couples and studios rely on continuous access to their photographs. AuraPix AI maintains a 99.9% monthly service uptime SLA for all public-facing gallery and album viewing endpoints, excluding pre-announced scheduled maintenance windows.

9. Account Cancellation & Suspension

You may cancel your subscription at any time directly through your Studio Dashboard or by messaging our WhatsApp support. Following cancellation:

• Your service remains fully active through the end of your prepaid billing period.
• You are provided a 30-day grace period to download all original high-resolution RAW and JPEG files before permanent cloud deletion.

10. Governing Law, Jurisdiction & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, action, or proceeding arising under or related to these terms shall be subject to the exclusive jurisdiction of the competent courts situated in Jaisalmer, Rajasthan, India.
